Terms of Service
Effective 1 September 2026
TV Binge Diary is a personal diary for the TV you watch, with a public discussion under each show and episode. It is operated by Geri Luga, a sole trader established in Albania, reachable at g.luga@codevider.com. These terms are the agreement between you and us; by creating an account or using the service you accept them. If you do not, do not use the service.
These terms cover the website and the iOS and Android apps alike. They incorporate the Community Guidelines, which say what may and may not be posted, and the Privacy Policy, which says what we do with your data.
Who may use it
You must be at least 13 years old, and at least 16 if you are in the European Economic Area or the United Kingdom. If the law where you live sets a higher age for agreeing to a contract like this one, that age applies to you. By using the service you confirm you meet it, and that nothing in the law of your country prevents you from agreeing to these terms.
Your account
An account is for one person, and it is yours to look after: keep your password and your sign-in codes to yourself, and tell us at g.luga@codevider.com if you think somebody else has got into your account. What happens under your account is your responsibility, unless it happened because of something we did wrong.
Your handle is the name your comments are signed with. It is claimed once and then kept, because a handle that could be released and re-taken would let the next person to hold it appear to have written everything the previous holder ever posted. Handles that impersonate somebody else, or that are chosen to abuse or mislead, will be taken back. You may not sell, rent, or transfer an account or a handle.
What you may do with the service
We give you a personal, non-exclusive, non-transferable, revocable licence to use TV Binge Diary on devices you own or control, for your own non-commercial use, for as long as you keep to these terms. Nothing here transfers ownership: the software, the design, the name, and everything we made stay ours. You may not copy, sell, rent, sublicense, reverse-engineer, or make derivative works of the service, except to the precise extent the law says you may despite a term like this one.
The service is free. There is nothing to buy inside it, no subscription, and no advertising.
Your diary and your content
Your diary is yours. We store it to run the service for you, as described in the Privacy Policy, and you can delete your account — taking all of it with you — at any time from the Profile screen.
Anything you write in a discussion stays yours too. So that we can actually show it, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it inside the service and to other members, and to make the technical copies that hosting requires. That licence exists only to run the service — we do not licence your comments to anyone else, and it ends when you delete the comment or your account, except for copies already made in routine backups, which expire on their own.
You are responsible for what you post, and you confirm you have the right to post it.
Discussions: zero tolerance
There is no tolerance for objectionable content or for abusive behaviour towards other members. Posting it will get the content removed and can get your account suspended or closed immediately and without notice. In particular, you may not post, link to, or use the service to send anything that:
- harasses, bullies, threatens, or incites violence against anyone, or attacks a person or a group over race, ethnicity, national origin, religion, caste, disability, disease, age, sex, gender, gender identity, or sexual orientation;
- sexualises a minor in any way, or is sexually explicit, obscene, or pornographic;
- is unlawful, defamatory, or infringes anyone's copyright, trademark, privacy, or other rights;
- is spam, advertising, a scam, a phishing attempt, or bulk repetitive posting;
- impersonates another person, or misrepresents your affiliation with anyone;
- publishes private information about another person without their permission;
- links to pirated streams, downloads, or other infringing copies of the shows being discussed;
- contains malware, or is designed to break, probe, overload, or work around any limit in the service.
Deliberately spoiling a plot outside a marked spoiler is not in that list — it is not abuse — but it is against the Community Guidelines and it will be removed. The Guidelines describe the whole standard, including how we handle reports and what you can do about a decision.
Reporting, blocking, and what we do
Every comment carries a report control, and every comment carries a block control. Reporting sends it to us with a reason; blocking removes that person from your view of every discussion immediately and stops them reaching you, and you can undo it from the Profile screen. We read every report, and we act on objectionable content and abusive users as quickly as we can. Nothing is hidden automatically on a count of reports — that would hand a group of people a way to silence someone — and nothing is filtered by a machine that does not understand what a show is about.
We may remove content, restrict or suspend an account, or close it, when these terms or the Guidelines are broken. Where we can, we say what happened and why. Where the content is illegal, or the account exists to abuse people, we act first.
Acceptable use of the service itself
Use the service as a person keeping a diary, not as a machine. Do not scrape it in bulk, do not try to enumerate accounts, do not attempt to reach anybody else's data, do not probe or overload it, and do not work around a rate limit. Automated access is not permitted without our written agreement.
Copyright complaints
If something on the service infringes your copyright, write to g.luga@codevider.com with enough for us to act: identify the work, identify the exact comment or page, give us your contact details, and state that you believe in good faith the use is not authorised and that what you have told us is accurate. We remove infringing material and we close the accounts of repeat infringers. If your content was removed and you think that was wrong, write to the same address and say so.
Series data
Series names, artwork, summaries, and air dates are provided by TheTVDB and remain the property of their respective owners. We are not affiliated with TheTVDB, with any broadcaster, or with any streaming service. We do not control that data, we cannot guarantee it is complete or correct, and the service is not a place to watch anything.
The service is provided as it is
We work to keep the service fast, correct, and available, but we provide it “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not promise uninterrupted operation, that air dates or episode data are accurate, or that anything you post will be preserved — keep your own copy of anything you would miss.
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost opportunity, arising out of your use of the service; and our total liability for any claim relating to the service is limited to 50 euro, which reflects that the service is free.
None of that takes away rights you have as a consumer that cannot be taken away. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. If you are a consumer in the EEA or the UK, your statutory rights stand whatever this section says.
Ending things
You can stop using the service and delete your account whenever you like, from the Profile screen — see deleting your account. We may suspend or close an account that breaks these terms or the Guidelines, and we may discontinue the service; if it is ever shut down, we will give notice in the app first and leave time to take your data out. Sections that by their nature outlive the agreement — the licence you gave us for content already posted, the disclaimers, the liability limit, and the law that governs a dispute — survive it.
Which law applies
These terms are governed by the law of Albania, and the courts of Tirana have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings in your own local courts. Before either of us goes to court, write to g.luga@codevider.com — almost everything is settled faster that way.
If you installed the app from Apple
These terms are between you and us, not between you and Apple, and we alone are responsible for the app and its content. Your licence to use the iOS app is limited to Apple-branded products you own or control, and is subject to the Usage Rules in Apple's App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any warranty that applies, you may tell Apple, and Apple will refund the purchase price — which is zero. Apple has no other warranty obligation, and any other claim, loss, liability, damage, cost, or expense arising from a failure to conform is our responsibility.
- We, not Apple, are responsible for addressing any claim you or a third party makes about the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
- We, not Apple, are responsible for investigating, defending, settling, and discharging any claim that the app infringes a third party's intellectual property.
- You confirm you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and on your acceptance they have the right to enforce them against you.
Geri Luga, Albania — g.luga@codevider.com — is the developer to contact with any question or complaint about the app.
The rest
Changes
If these terms change, the new version is posted here with a new effective date, and a material change is announced in the app before it takes effect. Continuing to use the service after that is how you accept the change; if you would rather not, delete your account.
Everything else
These terms, with the Community Guidelines and the Privacy Policy, are the whole agreement between us about the service. If a court finds one part unenforceable, the rest stands. Our not enforcing something once is not giving it up. You may not transfer your rights under these terms; we may transfer ours to a successor who takes on the service, on notice to you.
